Please read these Terms carefully before creating an account or publishing a website on websites.co.zw. By ticking the acceptance checkbox during registration, you confirm you have read, understood, and agree to be bound by these Terms. These Terms constitute a legally binding agreement between you (the Customer) and Ya-Sibo Media (Private) Limited (the Company), the operator of websites.co.zw.

1. Definitions

Platform โ€” The websites.co.zw website builder service, including all software, infrastructure, tools, templates, and related services.

Customer / You โ€” Any individual or entity that creates an account on the Platform.

Site โ€” A website created using the Platform and hosted on a websites.co.zw subdomain or custom domain.

Content โ€” All text, images, logos, videos, data, and other material that a Customer uploads or publishes through the Platform.

Subscription โ€” A paid plan (Starter or Pro) that enables a Customer to publish and maintain a Site.

Payment Credentials โ€” A Customer's own Paynow Integration ID and Integration Key, provided by the Customer to enable direct collection of booking deposits or payments into the Customer's own Paynow account.

POTRAZ โ€” The Postal and Telecommunications Regulatory Authority of Zimbabwe.

CDPA โ€” Zimbabwe's Cyber and Data Protection Act (Chapter 12:07), enacted 2021.

2. Eligibility and Account Registration

2.1 Age and Capacity

You must be at least 18 years of age to create an account. By registering, you represent that you have the legal capacity to enter into a binding contract under the laws of Zimbabwe.

2.2 Accurate Information

You agree to provide accurate, current, and complete information when registering and to keep it up to date. The Company may suspend or terminate accounts where information is false, misleading, or incomplete.

2.3 One Account Per Business

Each account is intended for use by a single business or individual. Accounts may not be shared, sold, or transferred without written consent from the Company.

2.4 Multiple Sites Per Account

Your account may be used to create and publish more than one Site, each subject to its own applicable Subscription fee. Entitlements, payment benefits, and add-ons purchased for one Site do not extend to any other Site on your account.

3. Description of Services

The Platform provides:

4. Subscriptions, Fees, and Payment

4.2 Payment Processing

Subscription and add-on payments made to the Company are processed through Paynow. By making a payment, you also agree to Paynow's terms. The Company does not store card details or financial credentials in connection with these payments.

4.3 Grace Period and Suspension

If your subscription expires, your Site enters a 14-day grace period during which it remains visible. After the grace period, your Site is suspended. Your content is retained for 60 days after suspension, after which it may be permanently deleted.

4.4 Refunds

Subscription fees are non-refundable except where required by applicable Zimbabwe consumer protection law.

5. Owner Payment Accounts (Bookings Deposits)

5.1 What This Covers

If you activate deposit or full-payment collection for a bookable service (the "Bookings Pro" payment feature), you will be asked to connect your own Paynow merchant account by providing your Payment Credentials.

5.2 Where the Money Goes

Deposits and full payments collected through this feature are paid directly into your own connected Paynow account. The Company is not a party to these transactions, does not hold, custody, or have access to these funds at any point, and does not process refunds, chargebacks, or disputes on your behalf. Any dispute about a payment collected this way is between you and your customer, and separately between you and Paynow under Paynow's own terms of service.

5.3 How Your Credentials Are Stored

Your Payment Credentials are encrypted before storage using industry-standard encryption (AES-256), and the encryption key is held separately from the database in which the encrypted credentials are stored. Your Payment Credentials are never displayed back to you, any other user, or any Company staff member after initial entry, and are never transmitted to any third party other than Paynow itself, solely to process a payment you have configured.

You are responsible for:

You are responsible for correctly identifying, at the time you connect your account, whether your Paynow integration is registered for USD or ZiG (Zimbabwe Gold). The Company relies on your selection and does not independently verify it. A mismatch between the currency you select and the currency your Paynow account actually processes may result in a failed or rejected transaction, for which the Company is not responsible.

5.6 Revocation and Disconnection

You may disconnect your Payment Credentials from your dashboard at any time. Disconnecting immediately stops any new deposit or full-payment collection for your bookable services; it does not affect payments already collected before disconnection. Upon disconnection, your stored encrypted credentials are marked as revoked.

Product/legal decision pending: whether revoked credentials are deleted outright or retained in revoked state for a defined period. State the chosen policy here once decided.

5.7 Limitation of Liability

To the fullest extent permitted by law, the Company is not liable for:

Legal review needed: confirm with counsel whether the Company's role in facilitating the Payment Credentials connection and firing the charge request on the owner's behalf creates any regulatory obligation under Zimbabwe's Consumer Protection Act or applicable payment-services regulation, beyond what is drafted above.

6. Acceptable Use Policy

You must not use the Platform to create, host, or promote Content that:

You are solely responsible for all Content published on your Site. The Company acts as a hosting provider and mere conduit under the CDPA and reserves the right to remove Content and suspend Sites that violate these Terms or applicable law.

7. Content Moderation and Takedowns

7.1 Reporting Violations

Any person may report Content believed to be illegal or in violation of these Terms by emailing legal@websites.co.zw or using the Report link on any published Site.

7.2 Company Response

Upon receiving a valid report, the Company will acknowledge within 24 hours, review within 48 hours, and if a violation is confirmed, suspend the Site and notify the Customer with reasons and the right to respond within 5 business days.

7.3 Immediate Suspension

The Company reserves the right to suspend a Site immediately and without prior notice where the Content poses an imminent risk of harm, or where directed by a competent Zimbabwean authority including the Zimbabwe Republic Police, POTRAZ, or a court of competent jurisdiction.

7.4 Cooperation with Authorities

The Company will cooperate fully with lawful requests from Zimbabwean law enforcement and regulatory authorities, including disclosing Customer account information where required by valid legal process.

8. Intellectual Property

8.1 Your Content

You retain full ownership of all original Content you upload. By publishing through the Platform, you grant the Company a non-exclusive, royalty-free licence to host and display that Content solely for the purpose of operating your Site.

8.2 Platform Intellectual Property

All software, templates, designs, algorithms, and branding associated with websites.co.zw are the exclusive property of Ya-Sibo Media (Private) Limited.

9. Privacy and Data Protection

The Company collects your phone number for authentication, your business information as entered in the editor, payment confirmation records, and, where you activate the feature described in Section 5, your encrypted Payment Credentials. We process personal data in accordance with Zimbabwe's Cyber and Data Protection Act 2021. You have the right to request access to, correction of, or deletion of your personal data by contacting legal@websites.co.zw.

10. Disclaimers and Limitation of Liability

The Platform is provided on an as-is and as-available basis. The Company's total liability for any claim shall not exceed the subscription fees you paid in the 12 months preceding the claim. The Company shall not be liable for indirect, consequential, or punitive damages including loss of business, loss of data, or loss of revenue. Section 5.7 sets out additional, specific limitations applicable to Owner Payment Accounts.

11. Termination

You may close your account at any time by contacting support@websites.co.zw. The Company may terminate or suspend your account immediately if you breach these Terms, fail to pay subscription fees, or use the Platform in a manner that exposes the Company to legal liability. Upon termination, your content may be permanently deleted after 60 days.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Zimbabwe. Any dispute shall first be referred to mediation. If mediation fails within 30 days, the dispute shall be submitted to the exclusive jurisdiction of the courts of Zimbabwe sitting in Bulawayo.

13. Changes to These Terms

The Company may update these Terms from time to time. We will notify registered Customers of material changes via WhatsApp or email at least 14 days before the changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
